Definitions: This Service and website is operated by dbs-check.co.uk which is a trading name of DBS Check Limited Company Number 06762372. Herein after called “dbs-check.co.uk”, “we”, “us” or “our”. “You”, “Your” and “User” means the legal entity subject to these terms and conditions, whether an individual, a company or any other legal entity, and includes anyone reasonably appearing to us to be acting with your authority or permission. “dbs-check.co.uk” or “Service”, means the dbs-check.co.uk website and the dbs-check.co.uk Software System collectively.

The following terms and conditions govern your use of dbs-check.co.uk:

  1. Provisions:
    Each of the provisions contained in the Terms and Conditions shall be construed as being independent of every other, so that if any provision is held to be invalid or unenforceable by a court of competent authority, such determination shall not affect the validity of any other terms or conditions or stipulation detailed herein, which shall remain in full force and effect.
  2. Modifications of Terms:
    dbs-check.co.uk reserves the right to vary these terms and conditions from time to time. Any modifications of these conditions may be superseded in writing only by dbs-check.co.uk and may be made without notifying or consulting you, and they shall have precedence over conditions coming from you. You are advised to check the dbs-check.co.uk website Monthly to ascertain the prevailing terms and conditions. Use of dbs-check.co.uk for a period exceeding two weeks after changes to the Terms and Conditions have been published will constitute acceptance.
  3. Copyrights and Intellectual Property Rights:
    The ownership of all intellectual property rights including, for the avoidance of doubt, patents, copyright, trademarks and trade names in dbs-check.co.uk belong or are licensed to dbs-check.co.uk and any part of dbs-check.co.uk may not be transferred, copied, decompiled or reproduced in whole or in part in without the express permission in writing of dbs-check.co.uk except as is expressly provided in Section 50B of the Copyright Design and Patent Act. 1988.
  4. Disclaimer of Warranties:
    dbs-check.co.uk take all reasonable care to ensure that dbs-check.co.uk is kept up to date, we make no warranty or representation that any part is accurate or reliable, or that it will always be available, or that any problems will be corrected, or that it is free of viruses, errors and defects. If you download software or other material from dbs-check.co.uk, you do so at your own risk. dbs-check.co.uk may change any part of dbs-check.co.uk at any time without notice and without any liability. So far as permitted by law, dbs-check.co.uk will not be liable for any direct, indirect, incidental or consequential loss or damage that may arise out of your access, use or inability to use any part of dbs-check.co.uk.
  5. Limitation of Liability:
    dbs-check.co.uk will not be liable to you in contract, tort including negligence or otherwise for any indirect, consequential, special or incidental damage or loss arising from your use of or inability to use dbs-check.co.uk including without limitation, loss of business or profits, loss or corruption of data, loss caused by a virus or software defect, loss of or damage to property, claims of third parties, fines or penalties levied by any taxing or other authority or any other loss or damage. Any reliance you place on information obtained from dbs-check.co.uk will be at your own risk. You should consider seeking verification and the advice of independent advisers before using information obtained from dbs-check.co.uk in employment disciplinary or any other matters. The operators of dbs-check.co.uk its agents and employees, are not liable for any losses or damages arising from your use of this site, other than in respect of death or personal injury caused by their negligence or in respect of fraud.
  6. Data Retention:
    Our objective is to handle all data accurately, fairly and securely. Any information you give us will be stored on dbs-check.co.uk computer systems and may be disclosed to, processed and used by us, and the other companies that assist us in providing our services. Any data will be held by us, will be stored according to our Data protection policy, and will only be retained by us for as long as it is needed to provide our services to you.
  7. User Names and Passwords:
    It is your responsibility to always keep all User ID and Passwords safe and secret. You must never disclose them or write them down in a way that could be understood by anyone else. You must change any compromised password immediately. The User warrants that any person to whom their user name or password is disclosed is legally authorised to act as the User’s agent for the purposes of transacting via the Service. The User further warrants that they have sole access to any email address associated with their dbs-check.co.uk user account, and that they authorise dbs-check.co.uk to send password resets and other private information to this email address, and that any correspondence sent to this email address will be considered delivered and read by the user.
  8. Payment:
    The charges will be calculated and invoiced for payment. For all services provided, Pre-payment will be required before any services are delivered, unless other payment arrangements are agreed by both parties.
  9. Transfer:
    We reserve the right to transfer this Agreement to any third party at any time. You may not transfer this Agreement to anyone else unless we have agreed in writing beforehand, and we shall not unreasonably withhold such agreement.
  1. External Links:
    Links contained in dbs-check.co.uk may lead to other websites. Although checked regularly, they are not under our control. We are not responsible for the content of any linked website and cannot take responsibility for the consequences of your using the information or services on linked websites. We cannot guarantee that these links will work all the time.
  2. Security:
    Communication across the dbs-check.co.uk system is via an encrypted tunnel or https over the internet. Use of the internet and email is not a 100% secure communications medium. In the interests of preserving confidentiality in your personal details, we strongly advise that you take this into consideration before you send us any information electronically. You agree that any information you send us will be at your own risk.
  3. Provision of Service:
    dbs-check.co.uk may require maintenance or fail without notice. We reserve the right to modify or withdraw, temporarily or permanently, any part of dbs-check.co.uk without notice to you, and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal. You will not be eligible for any compensation because you cannot use any part of dbs-check.co.uk or because of a failure, suspension or withdrawal of all or part of dbs-check.co.uk.
  4. Termination:
    We will be entitled to suspend access to the dbs-check.co.uk Service (i.e. restrict your access to the Service for a designated period of time) and/or terminate the Agreement and Service with immediate effect by notice to you, if we are aware of or have reason to believe that any Services or User ID /password used in relation with dbs-check.co.uk is/are being used in an unauthorised, unlawful, improper or fraudulent way whether this is with your consent or not. You must cancel your agreement with us in writing by a method of sending that produces a proof of receipt by dbs-check.co.uk.
  5. Indemnities:
    The User agrees to indemnify us against any claims brought by a third party resulting from the User’s use of dbs-check.co.uk and in respect of any losses or liabilities incurred directly by dbs-check.co.uk as a result of the User’s breach or non-observance of any of these terms and conditions. The User shall pay all costs, damages, awards, fees (including any reasonable legal fees) and judgements awarded against dbs-check.co.uk arising from any such claims and shall provide dbs-check.co.uk with notice of such claims, full authority to defend, compromise or settle such claims and reasonable assistance necessary to defend such claims, at the Users sole expense. The provisions of this paragraph 7 shall survive any termination of this agreement.
  6. Orders:
    You warrant that the User Information which you are required to provided to dbs-check.co.uk is true, current and complete in all respects. You also agree to update the User Information of any changes as soon as they occur.
  7. Back Up / Virus Protection:
    The onus is entirely on you to have a verified, recoverable back up and Anti-virus procedure in place. We make every effort to check and test dbs-check.co.uk. We cannot accept any responsibility for any damage to your computer system or loss of data caused by using dbs-check.co.uk. You must not knowingly or recklessly transmit via dbs-check.co.uk any material which contains viruses or other code or defects which are likely to cause damage to any system or data, or engage in any other activity which is in breach of the Computer Misuse Act 1990.
  8. Data Protection:
    The User agrees that the User will, when using the Service, observe the provisions of the Data Protection Act 2018 and subsequent amending legislation.
  9. Illegal Activity:
    The User must not use dbs-check.co.uk to engage in activity which is in breach of any applicable national or international laws.
  10. Disclaimer of Agency:
    Nothing in this Agreement shall be construed to create a joint venture, partnership or agency relationship between the User and dbs-check.co.uk. The parties to this Agreement are independent contractors, and neither party shall have the right nor authority to incur any liability debt or cost or enter into any contracts or other arrangements in the name of or on behalf of the other.
  11. Entire Agreement:
    The terms and conditions contained in this Agreement constitute the entire agreement between dbs-check.co.uk and you, the User, and supersedes all other communications.
  12. Acceptance:
    The User acknowledges that the User has read and accepted the terms of this Agreement. Use of the Service shall be deemed as acceptance of the terms of this Agreement. If you do not agree to be bound by these terms and conditions, you may not use or access dbs-check.co.uk. If at any time you do not agree to these terms, please leave the dbs-check.co.uk website immediately.
  13. Applicable Law:
    This Agreement shall be governed by and construed in accordance with the laws of England and Wales, and both parties hereby submit to the exclusive jurisdiction of the courts of England and Wales.

Money-Back Guarantee

A Result Summary in 1 Working Day, or your Money Back (Admin Fee Only)

Subject to the full Guarantee Terms. If the Result Summary is not available to view in your dbs-check.co.uk account by 23:59 (UK time) on the next working day after the DBS has confirmed your application was accepted (DBS Receipt Confirmation Time), we will refund our Admin Fee to the original payment method. The DBS Application Fee is non-refundable.

How to claim (required): Within 14 days, log in to dbs-check.co.uk and click “Apply for a refund” in your application Timeline. Your claim time is recorded in your Timeline and you will receive an email confirming we have received your claim. If you do not receive the confirmation email within 24 hours, you must email contact@dbs-check.co.uk (subject: Refund Request) with your E-application number within the same 14-day period.

The DBS paper certificate is issued and posted separately by the DBS and is not covered by this guarantee.

Full Guarantee Terms

A Result Summary in 1 Working Day, or your Money Back (Admin Fee Only)

This guarantee is offered by dbs-check.co.uk and applies only to our paid Admin Fee. It does not apply to the DBS Application Fee.

1) Definitions

  • Admin Fee: the fee paid to dbs-check.co.uk for Admin services (including Digital ID handling, application processing and submission Admin).
  • DBS Application Fee: the statutory application fee charged by the UK Government’s Disclosure and Barring Service (DBS) per application.
  • Working day: Monday to Friday, excluding UK bank holidays (UK time).
  • DBS Receipt Confirmation Time: the time our system records confirmation from the DBS that your application has been accepted/received by the DBS.
  • Result Summary (Available): the point at which the DBS outcome/status is made available to view as a Result Summary in your dbs-check.co.uk account (whether or not you log in to view it).
  • Guarantee Deadline: 23:59 (UK time) on the next working day after the DBS Receipt Confirmation Time.

2) What the guarantee covers

If you purchase a Basic DBS check through dbs-check.co.uk and the Result Summary is not available by the Guarantee Deadline, you may claim a refund of the Admin Fee only.

3) When the clock starts

The guarantee clock starts only when all of the following have occurred:

  • your Digital ID check has been successfully completed; and
  • your application has been correctly submitted to the DBS; and
  • we have received DBS confirmation that the application has been accepted/received (DBS Receipt Confirmation Time).

4) What you get back

If your claim is approved:

  • we will refund only the Admin Fee to the original payment method.

This guarantee covers availability of the Result Summary in your account only. It does not cover printing, postage, or delivery times for the DBS paper certificate. The DBS Application Fee is non-refundable under any circumstances.

5) How eligibility is decided

Eligibility is determined only using the timestamps and status records in our system (based on DBS confirmations/status updates). It does not depend on when you log in or when you check your account.

6) Exclusions

This guarantee does not apply where (a) the claim is not submitted using the valid method set out in section 7, or (b) the delay arises from:

  • DBS maintenance, outages, system issues, or other DBS delays outside our reasonable control;
  • incomplete, inaccurate, inconsistent, or misleading information provided by you;
  • DBS rejection due to information provided or omitted by you;
  • DBS raising additional checks, queries, or processing requirements;
  • resubmissions or corrections required because information was missing/incorrect; or
  • any circumstance preventing same-day submission or normal processing for reasons outside dbs-check.co.uk’s control.

7) How to request a refund (required method)

Refunds are not automatic. This is the only valid way to claim under this guarantee.

You must submit your claim within 14 days of the DBS Receipt Confirmation Time by:

  1. logging into dbs-check.co.uk; and
  2. clicking “Apply for a refund” in the application Timeline.

Your claim submission time is recorded in your Timeline. We will email you to confirm we have received your claim.

Fallback (only if confirmation email is not received): If you do not receive the confirmation email within 24 hours, you must email contact@dbs-check.co.uk within the same 14-day period:

  • Subject: “Refund Request”
  • Include: your E-application number and a short statement that you are claiming under the 1 Working Day Money-Back Guarantee.

Claims submitted outside the method above (for example by telephone, social media, or any route other than the portal claim process or the fallback email process described above) are not valid claims under this guarantee.

If approved, refunds are typically processed within 3 to 5 working days.

8) Chargebacks

If you believe you may be eligible, please submit a claim using the method above first so we can resolve it quickly.

If a chargeback is started, we may be unable to process a refund while the chargeback is open (to prevent double recovery). We may provide the card provider with evidence of the DBS Receipt Confirmation Time, Result Summary availability time, and your claim submission records (including Timeline logs and confirmation email records).

This guarantee is offered in addition to your statutory consumer rights.
